KAMU ALIMLARININ ELEKTRONİK ORTAMDA YAPILMASINA İLİŞKİN UYGULAMA YÖNETMELİĞİ TASLAĞI

 

BİRİNCİ BÖLÜM

Başlangıç Hükümleri

 

Amaç  ve kapsam

            MADDE 1- (1) Bu Yönetmeliğin amacı, 4/1/2002 tarihli ve 4734 sayılı Kamu İhale Kanunu veya istisna kapsamında yapılacak ihale, doğrudan temin ve bunlara ilişkin sözleşme süreçlerindeki işlemlerin Elektronik Kamu Alımları Platformu üzerinden gerçekleştirilmesine yönelik usul ve esasları düzenlemektir.

            Dayanak

            MADDE 2- (1) Bu Yönetmelik, 4734 sayılı Kanunun 53 üncü maddesi ile ek 1 inci maddesine dayanılarak hazırlanmıştır.

            Tanımlar ve kısaltmalar

            MADDE 3– (1) Bu Yönetmeliğin uygulanmasında 4734 sayılı Kanunun 4 üncü maddesindeki tanımlar yanında;

  1. DTN: Doğrudan temin kayıt numarasını,
  2. b) e-imza: 15/1/2004 tarihli ve 5070 sayılı Elektronik İmza Kanununun 4 üncü maddesinde tanımlanan güvenli elektronik imzayı,
  3. c) EKAP: Elektronik Kamu Alımları Platformunu,

ç) Entegrasyon: EKAP ile diğer elektronik sistemler/ortamlar arasında veri alışverişini sağlayan servisleri,

  1. d) İhaleye katılım belgesi: İstekli olabilecekler tarafından, ihalede istenen katılım ve yeterlik kriterlerinin sağlandığını göstermek ve varsa fiyat dışı unsurların değerlendirilmesinde kullanılmak üzere EKAP’ta hazırlanan belgeyi,
  2. e) İKN: İhale kayıt numarasını,
  3. f) İSKN: İstisnalara ilişkin ihale kayıt numarasını,
  4. g) İstisna: Kanun kapsamındaki idarelerin, bu Kanunda ya da diğer kanunlar ile bu Kanundan istisna edilen mal veya hizmet alımları ile yapım işlerini,

ğ) Kamu alımı: 4734 sayılı Kanun veya istisna kapsamında ihale ve doğrudan temin yoluyla yapılan alımları,

  1. h) Kanun: 4734 sayılı Kamu İhale Kanununu,

ifade eder.

 

İKİNCİ BÖLÜM

Genel Esaslar

           

İlke ve kurallar

            MADDE 4- (1) EKAP; Kanunun temel ilkeleri, bilgi güvenliği, veri bütünlüğü, erişilebilirlik, kişisel verilerin korunması, entegrasyon ve iş birliği ile hizmet kalitesinin sağlanması esasları çerçevesinde Kurum tarafından işletilir.

(2) İdareler ile diğer kurum ve kuruluşlarca EKAP üzerinden elde edilen bilgi ve belgeler amacı dışında kullanılamaz ve üçüncü kişilerle paylaşılamaz.

(3) EKAP’ta mevzuatın uygulanması amacıyla yapılan yönlendirmelere uyulması zorunludur. Bu zorunluluklara uyulmaması halinde EKAP üzerindeki iş ve işlemlerin gerçekleştirilmesi ile ilgili kısıtlamalar getirilebilir.

(4) Kamu alımı süreçlerinde kullanılmak amacıyla EKAP’a kaydedilen, yüklenen ya da aktarılan bilgi veya belgelerin geçerli, doğru ve eksiksiz olması gerekir. Bu şartları sağlamayan bilgi ve belgelerin kullanılmasından dolayı Kuruma herhangi bir sorumluluk yüklenemez.

(5) EKAP hesabına giriş yapılarak gerçekleştirilen işlemler kayıt altında tutulur. İhale, doğrudan temin ve sözleşme süreçlerinde bu kayıtlar esas alınır. İşlemlerin zamanının tespitinde TÜBİTAK Ulusal Metroloji Enstitüsü tarafından geliştirilen atom saati kullanılır.

(6) EKAP üzerinden işlemlerin güvenli ve etkin şekilde yapılabilmesine yönelik olarak “kullanıcı adı ve şifresi”, “e-imza”, “e-Devlet Kapısı” ve benzeri yöntemlerden biri veya birkaçı Kurum tarafından kimlik doğrulama yöntemi olarak belirlenir.

(7) Teknik sorunlar veya mücbir sebepler nedeniyle EKAP üzerinde işlem yapılamaması durumunda, işlemlerin mevzuata uygun şekilde sürdürülmesi ve hak kayıplarının önlenmesi amacıyla alternatif sistemleri ve uygulamaları devreye almaya, gerekli hallerde ilgili işlemleri durdurmaya, ertelemeye, yenilemeye, iptal etmeye, EKAP üzerinden yapılamayan işlemlerden hangilerinin fiziki ortamda yapılacağını belirlemeye ve diğer tedbirleri almaya Kurum yetkilidir.

EKAP’a kayıt işlemleri

MADDE 5– (1) İdareler ile EKAP üzerinden yürütülecek kamu alımı süreçlerine katılacak gerçek ve tüzel kişilerin EKAP’a kaydolması zorunludur.

(2) Birinci fıkra kapsamı dışında kalan kurum ve kuruluşlardan, EKAP’ta ilan veya benzeri işlemleri gerçekleştirmek isteyenler ile iş deneyim belgesi düzenlemeye yetkili olanların da kaydı zorunludur.

(3) Kayıt işlemlerinin elektronik ortamda yapılması esastır. Kayıt işlemlerine ve kullanıcılara ilişkin usul ve esaslar Kurum tarafından belirlenir.

EKAP üzerinden gerçekleştirilecek iş ve işlemler

MADDE 6- (1) Kanuna tabi ihaleler ile bunlara ilişkin sözleşmelere yönelik olarak 14 üncü maddede belirtilen işlemler EKAP üzerinden yürütülür.

(2) Aşağıda belirtilen süreçlere ilişkin işlemler de kısmen veya tamamen EKAP üzerinden yürütülebilir:

  1. a) İstisna kapsamında yapılan ihaleler ile bunlara ilişkin sözleşmeler.
  2. b) Doğrudan teminler ile bunlara ilişkin sözleşmeler.
  3. c) Kanun kapsamı dışında kalan her türlü ihale ile bunlara ilişkin sözleşmeler.

(3) İş deneyim belgeleri, yetkili kurum ve kuruluşlar tarafından EKAP üzerinden düzenlenir. Yerli veya yabancı gerçek/tüzel kişilerin, yurt dışında kamu veya özel sektöre bedel içeren bir sözleşme kapsamında taahhüt ettikleri yapım işlerine ilişkin iş bitirme belgeleri Kurum tarafından EKAP’a kaydedilir.

(4) Teminat mektuplarına ilişkin işlemler, 6/12/2012 tarihli ve 6362 sayılı Sermaye Piyasası Kanununa göre merkezî takas kuruluşu olarak faaliyet gösterenler dâhil yetkili kuruluşlar aracılığıyla yürütülür.

(5) Kurum tarafından idarelere, Kurum ve idareler tarafından ise aday, istekli, istekli olabilecek, yüklenici ve alt yüklenicilere tebligatlar EKAP üzerinden yapılır.

(6) Aday, istekli, istekli olabilecek, yüklenici ve alt yüklenicilerin idareye yapacakları talep ve başvurulardan Kurumca belirlenenler EKAP üzerinden gerçekleştirilir.

(7) Kayıtlı gerçek ve tüzel kişiler tarafından kamu alımı süreçlerine ilişkin yapılması gereken iş ve işlemler, EKAP’ta tanımlı alanlar üzerinde gerçekleştirilir.

(8) Kayıtlı gerçek ve tüzel kişiler tarafından, EKAP’taki işlemleri gerçekleştirmek üzere e-imza kullanılarak yetkilendirme yapılabilir.

(9) İhalelere yönelik şikâyet ve itirazen şikâyet başvuruları EKAP üzerinden yapılır.

(10) Kamu alımı süreçlerinde şekli ve içeriği Kurum tarafından belirlenerek Kurumun resmi internet sayfasında yayımlanan e-formlar kullanılır.

(11) Kurum tarafından belirlenen diğer iş ve işlemler de EKAP üzerinden gerçekleştirilir.

Tebligatlara ilişkin esaslar

            MADDE 7- (1) Tebligat, iş günlerinde ve 09.00-18.00 saatleri arasında (yarım mesai günlerinde 09.00-13.00) yapılır. Bu süreler dışında gönderilen tebligatlar, kaydedildiği tarihi takip eden ilk iş günü içinde ilgililerin bildirim kutusuna ulaştırılır. Tebligatın ilgililerin bildirim kutusuna ulaştığı tarih bildirim tarihi olarak kabul edilir ve bildirim tarihi tebliğ tarihi sayılır.

(2) Kendisine tebligat yapılan ilgilinin EKAP’ta kayıtlı e-posta adresine ve/veya mobil telefon numarasına, tebligatın yapıldığına dair bilgilendirme mesajı gönderilebilir. Bilgilendirme mesajının herhangi bir nedenle ilgiliye geç ulaşması veya ulaşmaması, tebligatın zamanını ve geçerliliğini etkilemez.

 

ÜÇÜNCÜ BÖLÜM

Kanuna Tabi İhalelere İlişkin İşlemler

           

            İhale hazırlık işlemleri

            MADDE 8- (1) İhale konusu işin yaklaşık maliyeti işin teknik özellikleri dikkate alınarak; iş kalemleri, birimler, girdiler ve benzeri bileşenler bazında EKAP’ta hazırlanır. EKAP aracılığıyla erişilemeyen fiyat veya rayiçlere dayanak teşkil eden bilgi ve belgeler EKAP’a yüklenir.

(2) İhale onay belgesi EKAP üzerinden düzenlenir ve ihale yetkilisi tarafından e-imza ile imzalanır.

(3) İhale konusu mal veya hizmet alımı ya da yapım işinin niteliği, türü ve miktarı, kısmi teklife izin verilmesi halinde kısımları, gerekli hallerde iş kalemleri ile diğer bilgiler EKAP’a girilerek ihale kaydı yapılır ve kaydı yapılan her bir ihaleye İKN verilir.

(4) İhale/ön yeterlik ilanı, düzeltme ilanı ile ihale ve/veya ön yeterlik dokümanı EKAP üzerinden hazırlanır. İdari şartnamenin hazırlanmasında Ek-1’de yer alan “Elektronik Ortamda Yapılan İhalelerde Uygulanacak Tip İdari Şartname” esas alınır. Doküman kapsamında EKAP’ta hazırlanamayan belgeler ayrıca yüklenir. Zeyilname ve açıklamalar EKAP üzerinden oluşturulur ve zeyilname/açıklama tarihine kadar doküman indirenlerin tamamına bildirilir. Zeyilname düzenlenmesi halinde, aday veya istekliler başvurularını/tekliflerini geri çekerek yeniden teklif verebilir.

(5) İhale komisyonu, ihale/ön yeterlik ilanı veya davet tarihini izleyen en geç üç gün içinde yedek üyelerle birlikte EKAP’ta oluşturulur. İhale komisyonu üyelerine görevli oldukları ihaleyle ilgili ihale işlem dosyasına EKAP üzerinden erişim yetkisi verilir.

İhale ve/veya ön yeterlik dokümanının görülmesi ve indirilmesi

MADDE 9– (1) İhale ve/veya ön yeterlik dokümanı EKAP’ta görülebilir. Ancak istekli olabilecek sıfatının kazanılabilmesi için EKAP hesabına giriş yapılarak dokümanın indirilmesi zorunludur.

(2) İlan yapılmayan ihalelerde, ihale dokümanı sadece davet edilenlerce görülebilir ve indirilebilir.

(3) Ortak girişimlerde ortaklardan herhangi birinin dokümanı indirmiş olması yeterlidir.

           

            Başvuru ve/veya tekliflerin hazırlanması ve gönderilmesi

            MADDE 10- (1) Başvuru ve/veya tekliflerin gönderilmesinde e-teklif kullanılır. e-teklifler; başvuru/teklif mektubu ve ekleri ile idari şartname düzenlemeleri esas alınarak oluşturulan ihaleye katılım belgesi doldurularak hazırlanır ve e-imza ile imzalanarak ihale tarih ve saatine kadar gönderilir.

(2) İhaleye katılım belgesinin hazırlanmasında;

  1. a) Doğrudan EKAP’ta oluşturulan,
  2. b) Entegrasyonlar aracılığıyla erişilen,
  3. c) (a) veya (b) bendi kapsamı dışındakilere ilişkin EKAP’a yüklenen,

bilgi ve belgeler kullanılır. Entegrasyonlardan kaynaklanan teknik sorunlar nedeniyle gerekli bilgi ve belgelere ulaşılamaması durumunda bunlara ilişkin belgeler de (c) bendi kapsamında EKAP’a yüklenir. (c) bendi kapsamında yüklenecek belgelerin, belgelerin sunuluş şekline ilişkin şartları taşıması gerekir.

(3) Aday ve istekliler, ikinci fıkra kapsamındaki bilgi ve belgelerin tam, doğru ve güncel olmasını sağlamakla yükümlüdür.

(4) Ortak girişimlerde, ihaleye katılım belgesi her bir ortak tarafından ayrı ayrı doldurulur ve başvuru/teklif ortakların tamamı tarafından imzalanır.

(5) Kısmi teklife açık ihalelerde, ihaleye katılım belgesi her bir kısım için ayrı ayrı doldurulur.

(6) Tekliflerin gönderilebilmesi için ihaleye katılım belgesindeki zorunlu alanların doldurulması ve geçici teminat tutarının yeterli olması gerekir.

(7) Başvuru ve teklifler EKAP tarafından güvenli şifreleme yöntemleri ile saklanır.

Başvuru ve/veya tekliflerin açılması

            MADDE 11- (1) Teklifler, ihale komisyonu tarafından ihale tarih ve saatinde EKAP’ta açılır. Yaklaşık maliyet tutarı ve teklif fiyatları isteklilerin erişimine açılır. Bu aşamada, isteklilerin geçici teminatlarının uygun olup olmadığı, EKAP üzerinden yapılan sorgulamalara göre; ihale tarihi itibarıyla ihalelere katılmaktan yasaklı olup olmadığı ile vergi ya da sosyal güvenlik prim borçlarının bulunup bulunmadığı kontrol edilir. Yabancı isteklilerin, kendi ülkelerinin mevzuat hükümleri uyarınca ihale tarihi itibarıyla kesinleşmiş vergi ya da sosyal güvenlik prim borçlarının bulunup bulunmadığına ilişkin kontrol ise sözleşmenin imzalanması aşamasında gerçekleştirilir.

(2) Birinci fıkra kapsamında yapılan işlemlere ilişkin hususlar ile yaklaşık maliyet tutarı, teklif fiyatları ve varsa açılamayan teklifler tutanağa bağlanır ve bu tutanak da isteklilerin erişimine açılır.

(3) Pazarlık usulü ile yapılan ihalelerde son fiyat teklifleri, danışmanlık hizmet alımı ihalelerinde ise mali teklifler, yaklaşık maliyet ile birlikte isteklilerin erişimine açılır. Fiyat veya fiyat ile birlikte fiyat dışı unsurlar üzerinden elektronik eksiltme yapılması öngörülen ihalelerde eksiltme tamamlandıktan sonra yaklaşık maliyet ve teklif fiyatları isteklilerin erişimine açılır.

(4) Bu madde kapsamında yer alan hükümler, niteliğine uygun düştüğü ölçüde ön yeterlik/yeterlik başvurularının açılmasında da uygulanır.

Başvuru ve/veya tekliflerin değerlendirilmesi ile ihalenin karara bağlanması

            MADDE 12- (1) Teklifler açıldıktan sonra 11 inci maddenin birinci fıkrasına göre uygun bulunmayan teklifler değerlendirme dışı bırakılır. Pazarlık usulüyle yapılan ihalelerde son fiyat tekliflerinin alınması işlemi, elektronik eksiltme yapılan ihalelerde ise eksiltme işlemleri; teklifi bu aşamada değerlendirme dışı bırakılmayan istekliler davet edilerek gerçekleştirilir.

(2) Birinci fıkraya göre uygun olduğu anlaşılan tekliflerden, ekonomik açıdan en avantajlı birinci ve ikinci teklif olması öngörülenlerin değerlendirilmesine geçilir. Bu değerlendirme, idari şartname düzenlemeleri çerçevesinde ihaleye katılım belgesine aktarılan bilgi ve belgeler esas alınarak yapılır. Değerlendirme işlemi; aşırı düşük teklif açıklaması istenen ihalelerde, teklifi aşırı düşük olan isteklilerin tamamı için gerçekleştirilir. Belli istekliler arasında ihale usulüyle yapılan ihalelerde tüm başvurular ve/veya teklifler değerlendirilir.

(3) İkinci fıkraya göre yapılan değerlendirmede, ihaleye katılım belgesine aktarılan bilgi ve belgelerden; entegrasyonlar aracılığıyla veya EKAP ya da diğer kamu kurum ve kuruluşları ile kamu kurumu niteliğindeki meslek kuruluşlarının internet sayfası üzerinden erişilebilenlerin teyit işlemi gerçekleştirilir. 10 uncu maddenin ikinci fıkrasının (c) bendi kapsamında ihaleye katılım belgesine aktarılan belgelerden teyit edilemeyenler bu haliyle değerlendirmeye esas alınır ve tereddüt duyulması hali hariç bu belgelerin fiziki olarak sunulması istenmez.

(4) Aşırı düşük teklif açıklamaları, ikinci fıkra kapsamında yapılan teklif değerlendirmesi sonucunda teklifi geçerli olduğu tespit edilen isteklilerden istenir. Aşırı düşük teklif açıklamaları istekliler tarafından EKAP üzerinden e-imza ile imzalanmak suretiyle gönderilir. Açıklama kapsamında gönderilen belgeler bu haliyle değerlendirmeye esas alınır ve tereddüt duyulması hali hariç bu belgelerin fiziki olarak sunulması istenmez. Aşırı düşük teklif açıklamalarını EKAP üzerinden sunmayan, açıklamaları uygun bulunmayan veya fiziki olarak sunulması istenen belgeleri sunmayan isteklilerin teklifleri reddedilir.

(5) Numune/demonstrasyon istenen ihalelerde numune/demonstrasyon değerlendirmesi ekonomik açıdan en avantajlı birinci ve ikinci olması öngörülen teklifler için yapılır. Numune/demonstrasyon işlemlerine ilişkin yükümlülüklerini yerine getirmeyen isteklilerin teklifleri değerlendirme dışı bırakılarak geçici teminatları gelir kaydedilir.

(6) Değerlendirme işlemlerine, ekonomik açıdan en avantajlı teklif ile belirlenecek ise ekonomik açıdan en avantajlı ikinci teklif tespit edilinceye kadar devam edilir.

(7) Tekliflerin değerlendirilmesi sonucunda katılım ve yeterlik kriterlerine ilişkin şartları sağlamadığı anlaşılan istekliler ile numune/demonstrasyon değerlendirmesi başarısız sonuçlanan isteklilerin teklifleri değerlendirme dışı bırakılır ve bu tekliflerin değerlendirme dışı bırakılma gerekçeleri kaydedilerek EKAP üzerinden ihale komisyonu kararı oluşturulur. İhale komisyonu kararı, komisyon üyeleri tarafından e-imza ile imzalanır ve ihale yetkilisinin onayına sunulur. İhale yetkilisi karar tarihini izleyen en geç beş iş günü içinde, e-imza ile imzalamak suretiyle ihale kararını onaylar veya gerekçesini belirtmek suretiyle iptal eder. İhale kararı ihale yetkilisince onaylanmadan önce EKAP üzerinden yasaklılık teyidi yapılır.

(8) Kesinleşen ihale kararı, ihale yetkilisi tarafından onaylandığı veya iptal edildiği günü izleyen en geç üç gün içinde tüm isteklilere bildirilir.

(9) Üçüncü fıkra kapsamında fiziki olarak sunulması istenen belgeleri verilen makul süre içinde sunmayan veya belgelerin sunuluş şekline aykırı sunan istekliler ile yüklenen belgelerden farklı bir belge sunan isteklilerin teklifleri değerlendirme dışı bırakılır ve geçici teminatları gelir kaydedilir.

(10) Beşinci fıkra kapsamında numune/demonstrasyon işlemlerine ilişkin yükümlülüklerin yerine getirilmemesi ile dokuzuncu fıkrada sayılan fiiller ihale kararını etkileyecek davranış olarak kabul edilir ve bu davranışlarda bulunan istekliler hakkında Kanunun 17 nci madde hükümleri uygulanır.

(11) Bu madde kapsamında yer alan hükümler, niteliğine uygun düştüğü ölçüde ön yeterlik/yeterlik başvurularının değerlendirilmesinde de uygulanır.

Sözleşmenin imzalanması ve sonuç ilanı

MADDE 13– (1) Sözleşmeye davet EKAP üzerinden yapılır.

(2) Sözleşmeye davet edilen istekli tarafından sözleşme imzalanmadan önce sunulması gereken belgeler, sözleşmeye davet yazısının tebliğ tarihini izleyen on gün içinde EKAP üzerinden gönderilir. Yabancı istekliler için bu süreye oniki gün ilave edilir. Sözleşme imzalanmadan önce sunulması gereken belgelerden EKAP aracılığıyla erişilemeyenler, belgelerin sunuluş şekline uygun olarak EKAP’a yüklenir.

(3) Entegrasyonlar aracılığıyla veya EKAP ya da diğer kamu kurum ve kuruluşları ile kamu kurumu niteliğindeki meslek kuruluşlarının internet sayfası üzerinden teyit edilemeyen belgelerin,  idarece tereddüt duyulması hali hariç, fiziki olarak sunulması istenmez. Fiziki olarak sunulması istenen belgeleri sunmayan veya belgelerin sunuluş şekline aykırı sunan ya da yüklenen belgelerden farklı bir belge sunan istekli hakkında 12 nci maddenin dokuzuncu ve onuncu fıkra hükümleri uygulanır.

(4) Kesin teminat ve sözleşme imzalanmadan önce sunulması gereken diğer bilgi ve/veya belgeler kontrol edilerek sözleşmenin imzalanacağı tarihte yasaklılık teyidi yapılır.

(5) Sözleşme, taraflarca EKAP üzerinden e-imza ile imzalanır. Sonuç ilanı EKAP’ta ve Kamu İhale Bülteni’nde yayımlanır.

 

DÖRDÜNCÜ BÖLÜM

4735 Sayılı Kanuna Tabi Sözleşmelere İlişkin İşlemler

 

            EKAP üzerinden gerçekleştirilecek sözleşme işlemleri

            MADDE 14- (1) 5/1/2002 tarihli ve 4735 sayılı Kamu İhale Sözleşmeleri Kanununa tabi sözleşmelere ilişkin aşağıdaki işlemler EKAP üzerinden gerçekleştirilir:

  1. a) Yer teslim tutanağının düzenlenmesi/yüklenmesi.
  2. b) Teknik personel bildirimi ve onayı.
  3. c) Revize programlar dâhil iş programı başvuruları ve bunlara ilişkin onaylar.

ç) Alt yüklenici onay başvurusu ve onayı ile alt yüklenici sözleşmesinin yüklenmesi.

  1. d) Proje değişikliği, iş artışı ve iş eksilişi onayları.
  2. e) Süre uzatımı başvuru ve onayları.
  3. f) Mücbir sebep başvuru ve onayları.
  4. g) Rapor ve teknik doküman onay başvurusu ve onayı.

ğ) Yeni birim fiyat ve revize birim fiyat işlemleri.

  1. h) Fiyat farkı hesap işlemleri.

ı) Hakediş başvuruları, hakediş raporlarının düzenlenmesi ve onaylanması, ihtirazi kayıt ve kesin hesap işlemleri.

  1. i) Denetim, ara denetim ve kontrol teşkilatı görevlendirmelerine ilişkin onaylar ile cezalar dâhil yapılacak işlemlere ilişkin belge ve tutanakların düzenlenmesi.
  2. j) Kabul başvuruları, muayene ve kabul komisyonlarının oluşturulması, muayene ve kabul sürecinde yapılacak işlemlere ilişkin belge ve tutanakların düzenlenmesi.
  3. k) Ek kesin teminatların alınması, kesin ve ek kesin teminatların iadesine ilişkin işlemler.
  4. l) Sigorta poliçelerinin yüklenmesi.
  5. m) Sözleşme devir başvuruları ve onayları.
  6. n) Sözleşme fesih ve tasfiye işlemleri.
  7. o) Kurum tarafından belirlenecek diğer işlemler.

 

BEŞİNCİ BÖLÜM

MADDE 15- (1) İstisna kapsamındaki ihalelerin EKAP’a kaydedilerek İSKN alınması, ihale üzerinde kalan istekli için yasaklılık teyidi yapılması ve ihale sonucuna ilişkin bilgilerin en geç on beş gün içinde Kuruma bildirilmesi zorunludur.

(2) İstisna kapsamında yapılan ihalelerde; onay belgesi,  yaklaşık maliyet, ilan/davet, ihale dokümanının yüklenmesi, fiyat tekliflerinin kaydı, e-teklif, e-eksiltme, teminat, sözleşme işlemleri, bildirim ve tebligatlar ile benzeri hususlara ilişkin işlemlerden Kurumca belirlenenler EKAP üzerinden yürütülür.

Doğrudan temin işlemleri

MADDE 16- (1) Doğrudan temin yöntemiyle yapılan alımların EKAP’a kaydedilerek DTN alınması ve alım sonucuna ilişkin bilgilerin en geç alımın yapıldığı ayı takip eden ayın onuncu gününe kadar Kuruma bildirilmesi zorunludur.

(2) Doğrudan temin yöntemiyle yapılan alımlarda; onay belgesi,  piyasa fiyat araştırması, ilan/davet, dokümanın (şartname, sözleşme taslağı ve benzeri belgeler) yüklenmesi, fiyat tekliflerinin kaydı, e-teklif, e-eksiltme, teminat, sözleşme işlemleri, bildirim ve tebligatlar ile benzeri hususlara ilişkin işlemlerden Kurumca belirlenenler EKAP üzerinden yürütülür.

MADDE 17- (1) Bu Yönetmelikte düzenleme yapılmayan hususlarda ilgili uygulama yönetmelikleri esas alınır.

Yürürlükten kaldırılan yönetmelik ve atıflar

MADDE 18- (1) 25/2/2011 tarihli ve 27857 sayılı Resmî Gazete’de yayımlanan Elektronik İhale Uygulama Yönetmeliği yürürlükten kaldırılmıştır.

(2) Birinci fıkra uyarınca yürürlükten kaldırılan Yönetmeliğe diğer mevzuatta yapılan atıflar, bu Yönetmeliğe yapılmış sayılır.

Başlamış olan ihaleler

GEÇİCİ MADDE 1- (1) Bu Yönetmeliğin yürürlüğe girdiği tarihten önce ilanı veya yazılı olarak duyurusu yapılmış olan ihaleler, ilanın veya duyurunun yapıldığı tarihte yürürlükte olan hükümlere göre sonuçlandırılır.

Uygulanmaya başlama süresi

GEÇİCİ MADDE 2- (1) Bu Yönetmeliğin;

  1. a) 8 inci maddesinin birinci fıkrası,
  2. b) 14 üncü maddesi,
  3. c) Belli istekliler arasında ihale usulü ve 4734 sayılı Kanunun 21 inci maddesinin birinci fıkrasının (a), (d) ve (e) bentleri gereğince pazarlık usulü ile gerçekleştirilen ihalelerde, e-tekliflerin hazırlanması, gönderilmesi, açılması, değerlendirilmesi ile ihalenin karara bağlanması ve sözleşmenin imzalanmasına ilişkin hükümleri,

gerekli teknik altyapının tamamlanması üzerine Kurum tarafından belirlenerek resmi internet sayfasında duyurulacak tarihten itibaren uygulanır.

 

(2) Kurum, 14 üncü maddenin birinci fıkrasında sayılan bentlerin uygulanmaya başlanacağı tarihleri ayrı ayrı belirlemeye yetkilidir. Söz konusu bentlerin uygulanmaya başlanacağı tarihe kadar idareler tarafından; ilk sözleşme bedeli, ek sözleşme bedeli, toplam sözleşme bedeli, iş bitim tarihi, kabul tarihi, hesaplanan fiyat farkı tutarları, hakediş ödemelerine esas sözleşme fiyatları ile yapılan iş/hizmet tutarları, mal alımlarında sözleşme fiyatları ile ödenen tutarlar, sözleşme devredilmişse devir bilgileri ile feshedilmiş ise fesih bilgilerinin EKAP’a kaydedilmeye devam edilmesi zorunludur.

(3) Şikâyet ve itirazen şikâyet başvurularının EKAP üzerinden yapılmasına ilişkin olarak, 3/1/2009 tarihli ve 27099 sayılı Resmî Gazete’de yayımlanan İhalelere Yönelik Başvurular Hakkında Yönetmeliğin geçici 8 inci maddesi saklıdır.

MADDE 19- (1) Bu Yönetmelik, … tarihinde yürürlüğe girer.

Yürütme

MADDE 20- (1) Bu Yönetmelik hükümlerini Kamu İhale Kurumu Başkanı yürütür.
