2023/1139386 İhale Kayıt Numaralı “4 (Dört) Adet Römorkör Alımı” İhalesi

 

KURUM TARAFINDAN YAPILAN İNCELEME:

Boru Hatları ile Petrol Taşıma A.Ş. Tedarik ve Sözleşmeler Daire Başkanlığı tarafından 30.11.2023 tarihinde 4734 sayılı Kanun’un “İstisnalar” başlıklı 3’üncü maddesinin (g) bendi ile Geçici 4’üncü maddesi kapsamında istisna olarak gerçekleştirilen “4 (Dört) Adet Römorkör Alımı” ihalesine ilişkin olarak başvuru sahibince 27.02.2024 tarih ve 134367 sayı ile Kurum kayıtlarına alınan dilekçe ile başvuruda bulunulmuştur.

 

Başvuruya ilişkin olarak 2024/288 sayılı dosya kapsamında yapılan inceleme neticesinde ön inceleme raporu tanzim edilmiştir.

 

KARAR:

Ön inceleme raporu ve ekleri incelendi.

 

Kurum kayıtlarına 27.02.2024 tarih ve 134367 sayı ile alınan Ankara 17. İdare Mahkemesi’nin 11.01.2024 tarihli ve E: 2024/28, K: 2024/29 sayılı idari merci tecavüzü kararı ekinde Kuruma gönderilen dava dilekçesinde özetle; “Boru Hatları ile Petrol Taşıma A.Ş. tarafından 30.11.2023 tarihinde gerçekleştirilen 2023/1139386 İKN’li “4 (dört) Adet Römorkor Alımı” ihalesi sonucunda en uygun teklif sahibi ile sözleşme imzalanması işleminin hukuka aykırı olduğunun ileri sürülerek iptali gerektiği” iddialarına yer verilmiştir.

 

4734 sayılı Kanun’un “İstisnalar” başlıklı 3’üncü maddesinin (g) bendinde; “2 nci maddenin birinci fıkrasının (b) ve (d) bentlerinde sayılan kuruluşların, ticarî ve sınaî faaliyetleri çerçevesinde; doğrudan mal ve hizmet üretimine veya ana faaliyetlerine yönelik ihtiyaçlarının temini için yapacakları, Hazine garantisi veya doğrudan bütçenin transfer tertibinden aktarma yapmak suretiyle finanse edilenler dışındaki yaklaşık maliyeti ve sözleşme bedeli ikitrilyon üçyüzmilyar Türk Lirasını (Doksanbeşmilyonbeşyüzsekizbindokuzyüzyetmişbir Türk Lirası) aşmayan mal veya hizmet alımları,…

…Ceza ve ihalelerden yasaklama hükümleri hariç bu Kanuna tâbi değildir” hükmü yer almaktadır.

 

Aynı Kanun’un 53’üncü maddesinde Kamu İhale Kurumunun görevleri belirtilmiş olup, bu görevler arasında, bu Kanun kapsamında yapılan ihalelerde, ihalenin başlangıcından sözleşmenin imzalanmasına kadar olan süre içerisinde idarece yapılan işlemlere ilişkin olarak yapılan itirazen şikayet başvurularının incelenip sonuçlandırılması görevi bulunmaktadır.   

 

54’üncü maddesinin birinci fıkrasında “İhale sürecindeki hukuka aykırı işlem veya eylemler nedeniyle bir hak kaybına veya zarara uğradığını veya zarara uğramasının muhtemel olduğunu iddia eden aday veya istekli ile istekli olabilecekler, bu Kanunda belirtilen şekil ve usul kurallarına uygun olmak şartıyla şikâyet ve itirazen şikâyet başvurusunda bulunabilirler.

Başvuruların ihaleyi yapan idare veya Kurum dışındaki idari mercilere ya da yargı mercilerine yapılması ve başvuru dilekçelerinin bu merciler tarafından ilgisine göre idareye veya Kuruma gönderilmesi hâlinde, dilekçelerin idare veya Kurum kayıtlarına girdiği tarih, başvuru tarihi olarak kabul edilir.

Belirtilen hususlara aykırılık içeren ve henüz başvuru süresi dolmamış olan başvurulardaki eksiklikler, idare veya Kurumun bildirim yapma zorunluluğu bulunmaksızın, başvuru süresinin sonuna kadar başvuru sahibi tarafından giderilebilir” hükmü,

 

Aynı maddenin onbirinci fıkrasının (c) bendinde “Başvurunun süre, usul ve şekil kurallarına uygun olmaması, usulüne uygun olarak sözleşme imzalanmış olması veya şikayete konu işlemlerde hukuka aykırılığın tespit edilememesi veya itirazen şikayet başvurusuna konu hususun Kurumun görev alanında bulunmaması hallerinde başvurunun reddine karar verilir.” hükmü yer almaktadır.

 

İhalelere Yönelik Başvurular Hakkında Yönetmelik’in “Başvuruların şekil unsurları” başlıklı 8’inci maddesinin beşinci fıkrasında “İtirazen şikayet dilekçelerine, başvuruda bulunmaya yetkili olunduğuna dair belgeler ile imza beyannamesinin aslı veya yetkili mercilerce onaylı örneklerinin, idareye verilen şikayet dilekçesinin bir örneği varsa şikayete idarece verilen cevabın bir örneği ile başvuru bedelinin, teminat alınan hallerde başvuru teminatının Kurum hesaplarına yatırıldığına dair belgenin eklenmesi zorunludur…” hükmüne,

 

“Ön inceleme konuları ve ön inceleme üzerine yapılacak işlemler” başlıklı 16’ncı maddesinde “(1) Başvurular öncelikle;

 

a) Başvuru konusunun Kurumun görev alanında bulunup bulunmadığı,

ç) Başvuru sahibinin, varsa vekil ya da temsilcisinin; adı, soyadı, unvanı, adresi, imzası ile başvuruda bulunmaya yetkili olunduğuna dair belgelerin ve imza beyannamesinin aslı veya yetkili mercilerce onaylı örneğinin bulunup bulunmadığı,

g) (Değişik bent: 25/01/2017-29959 R.G./2. md.) İdareye verilen şikayet dilekçesinin bir örneğinin ve idare tarafından şikayet üzerine alınan karar başvuru sahibine bildirilmiş ise bu kararın bir örneğinin eklenilip eklenilmediği,

ğ) Başvuru bedelinin, teminat alınacak hallerde ise başvuru teminatının yatırılıp yatırılmadığı,

yönlerinden sırasıyla incelenir.

(3) Birinci fıkrada yer alan bilgi ve belgeleri içermeyen ve henüz başvuru süresi dolmamış olan itirazen şikâyet başvurularında, başvuru süresinin sonuna kadar söz konusu eksiklikler başvuru sahibi tarafından giderilebilir.

 

(4) Yapılan ön inceleme sonucunda, bir aykırılığın tespit edilmesi halinde bu hususa ilişkin ön inceleme raporu düzenlenir.” hükmüne,

 

  Aynı Yönetmelik’in “Ön inceleme konularına aykırılık üzerine alınacak kararlar” başlıklı 17’nci maddesinde ise “(1) 16’ncı maddenin birinci fıkrası bakımından bir aykırılığın tespiti üzerine Kurul tarafından başvurunun reddine karar verilir.” hükmüne yer verilmiştir.   

 

Yapılan inceleme sonucunda;

 

Bahse konu ihaleye ait ilanın “İhaleye katılabilme şartları ve istenilen belgeler ile yeterlik değerlendirmesinde uygulanacak kriterler” başlıklı 4’üncü maddesinde “Bu alım 4734 sayılı Kanunun 3. maddesinin (g) bendine istinaden çıkarılan Boru Hatları ile Petrol Taşıma A.Ş. İhale ve Alım Yönetmeliği’ne göre açık ihale usulü ile ihale edilecektir” düzenlemesine,  

 

17’nci maddesinde “Bu ihale, ceza ve ihalelerden yasaklama hükümleri hariç 4734 sayılı Kamu İhale Kanunu ve 4735 sayılı Kamu İhale Sözleşmeleri Kanunu hükümlerine tabi değildir” düzenlemesine yer verilmiştir.

 

Söz konusu ihalenin, 4734 sayılı Kamu İhale Kanunu kapsamında yapılmadığı, 4734 sayılı Kanun’un “İstisnalar” başlıklı 3’üncü maddesinin (g) bendi ile Geçici 4’üncü maddesi kapsamında bahse konu Kanun’dan istisna olarak gerçekleştirildiği anlaşılmış olup, 4734 sayılı Kanun kapsamından istisna tutulan bir ihaleyle ilgili olarak Kamu İhale Kurumu’nun inceleme görevi bulunmamaktadır.

 

Bu itibarla, 4734 sayılı Kanun’un 54’üncü maddesinin onbirinci fıkrasının (c) bendi gereğince başvurunun görev yönünden reddi gerekmektedir.

 

Açıklanan nedenlerle, 4734 sayılı Kanun’un 65’inci maddesi uyarınca bu kararın tebliğ edildiği veya tebliğ edilmiş sayıldığı tarihi izleyen 30 gün içerisinde Ankara İdare Mahkemelerinde dava yolu açık olmak üzere,

 

Başvurunun reddine,

 


Oybirliği ile karar verildi.

    May 24, 2024 I lost my cross bag containing my phone, ATM card and some valid ID card about two months ago or there about.
