Bilindiği üzere Elektronik İhale Uygulama Yönetmeliğinin “Kesin teminat mektupları” başlıklı Ek 1 inci maddesi uyarınca ihale üzerinde bırakılan istekli tarafından sözleşme imzalanmadan önce verilecek kesin teminat mektuplarının elektronik ortamda sunulmasına ilişkin usul ve esasları belirlemeye ve bu mektupların elektronik ortamda sunulması zorunluluğunu getirmeye Kurum yetkili kılınmıştır.
Bu kapsamda, 4734 sayılı Kamu İhale Kanun kapsamında yapılan ihalelerde sözleşme yapılmadan önce ihale üzerinde kalan istekli tarafından kesin teminat olarak sunulacak teminat mektubu ve kefalet senedinin İstanbul Takas ve Saklama Bankası A.Ş. (Takasbank) üzerinden elektronik ortamda düzenlenmesi ve iletilebilmesine yönelik geliştirme 22/01/2024 tarihinde devreye alınmıştır. (İlgili duyuru için tıklayınız.)
Gelinen aşamada, Kamu İhale Kurulunun 13/3/2024 tarihli ve 2024/DK.D-56 sayılı kararı ile; 4734 sayılı Kanun kapsamında yapılan ve ilan veya duyuru tarihi 8 Nisan 2024 ve bu tarihten sonra olan ihalelerde, sözleşme yapılmadan önce ihale üzerinde kalan istekli tarafından kesin teminat mektubu kapsamında yalnızca elektronik teminat mektubu veya elektronik kefalet senedinin sunulabileceğine karar verilmiştir.
Sözleşme sürecine ilişkin ek kesin teminat, avans teminatı, kesin hesap ve geçici kabul noksanları teminatı gibi diğer teminat türlerine ilişkin mektup ve kefalet senetlerinin elektronik ortamda sunulabilmesine ilişkin uygulama ise daha sonra devreye alınacak olup bunların fiziki ortamda sunulması devam edecektir.
