SON DÖNEM KAMU İHALE SÖZLEŞME FESİHLERİNE İLİŞKİN DEĞERLENDİRME VE YAPILAMSI GEREKENLER
Gördüğüm genel tablo 4735 sayılı Kanunun 20. Maddesinden bahisle ihale konusu iş zamanında bitirilmediğinden dolayı sözleşmeler fesih edilmektedir.
Bu durumda yükleniciler tarafından takip edilmesi gereken husus;
Adli yargıda haksız fesih davası açılması ve fesihten kaynaklı olarak alıkonulan teminat ve zararların talep edilmedir.
Ayrıca fesih öncesi veya fesihten sonra fesih davası ile teminata ihtiyati tedbir talep edilmelidir.
Yasaklama verilmesi durumunda yasaklamaya karşı yürütmeyi durdurma talepli iptal davası açılmalıdır.
Yerel mahkemelerce yasaklama verilmemesi yönünde ihtiyati tedbir kararları da seyrek de olsa verilebilmektedir.
Yine teminatın güncellenmesi ve rücu davalarının takibi de önem arz etmektedir.

İDARECE YAPILAN FESİH HAKSIZ İSE, YA DA FESİH DE İDARE DE KUSURLU İSE YUKARIDA YER VERİLEN YAPTIRIMLARIN UYGULANMASI MÜMKÜN DEĞİLDİR.
Konuya ilişkin yargı kararlarına bakıldığında yüklenici işi zamanında bitirememiş olsa da idarece projelerin geç onaylanması, hak edişlerin geç ödenmesi, gerekli süre uzatımlarının verilmemesi, konu YFK’ya götürülmesi gerekmesine rağmen bu süreç işletilmeden fesih kararı alınması, imar, ruhsat, gerekli izin ve kamulaştırma işlemlerinde idarenin gecikmesi ve kusurlu davranması durumunda feshin haksız olduğuna, idarenin fesihten kaynaklı hakları kullanamayacağına karar verilmektedir.
Bütün bu nedenlerle açılacak davalarda ve savunmalarda anılan hususların yükleniciler tarafından ortaya konulması önemli olduğu gibi, sözleşme sürecinde de anılan hususlara ilişkin yazışmalar önem arz etmektedir.
