Ayrıca fesih öncesi veya fesihten sonra fesih davası ile teminata ihtiyati tedbir talep edilmelidir.
Yasaklama verilmesi durumunda yasaklamaya karşı yürütmeyi durdurma talepli iptal davası açılmalıdır.
Yerel mahkemelerce yasaklama verilmemesi yönünde ihtiyati tedbir kararları da seyrek de olsa verilebilmektedir.
Yine teminatın güncellenmesi ve rücu davalarının takibi de önem arz etmektedir.
