4735 Sayılı Kamu İhale Sözleşmeleri Kanununun Geçici 7 nci Maddesinin Uygulanmasına İlişkin Esasların yürürlüğe konulmasına dair 15/1/2024 tarihli ve 8089 sayılı Cumhurbaşkanı Kararı 16/1/2024 tarihli ve 32431 sayılı Resmi Gazete’de yayımlanarak yürürlüğe girmiştir.
4735 Sayılı Kamu İhale Sözleşmeleri Kanununun Geçici 7 nci Maddesinin Uygulanmasına İlişkin Esaslar uyarınca;
1) 1/3/2023 tarihinden önce 4734 sayılı Kamu İhale Kanununa göre ihale edilen yapım işlerine ilişkin Türk lirası üzerinden yapılan ve 28/12/2023 tarihi itibarıyla devam eden sözleşmelerde, sözleşmenin 1/1/2024 tarihinden 31/12/2024 tarihine kadar (bu tarihler dâhil) gerçekleştirilen kısımları için;
– İhale dokümanında fiyat farkı hesaplanmasına ilişkin hüküm bulunan sözleşmelerde, sözleşmesine göre hesaplanan fiyat farkı B=0,90 katsayısı B=1,00 olarak uygulanmak suretiyle artırımlı olarak verilecektir. Ancak, Toplu Konut İdaresi Başkanlığı tarafından 2985 sayılı Toplu Konut Kanunu kapsamındaki konut ve konut ile birlikte ihaleye çıkılan yapım işlerinde B=0,90 yerine B=1,15 olarak uygulanacaktır.
– İhale dokümanında fiyat farkı hesaplanmasına ilişkin hüküm bulunmayan sözleşmelerde TÜİK Yurt İçi Üretici Fiyat Endeksindeki değişimin %15’i oranında fiyat farkı verilecektir.
Artırımlı fiyat farkı hesaplanabilmesi için yüklenicinin idareye yazılı olarak başvuruda bulunma şartı aranmayacaktır.
2) 1/3/2023 tarihinden önce 4734 sayılı Kanuna göre ihale edilen yapım işlerine ilişkin Türk lirası üzerinden yapılan ve 28/12/2023 tarihi itibarıyla devam eden sözleşmelerde, yüklenicinin 15/2/2024 tarihine kadar (bu tarih dâhil) idareye yazılı olarak başvurması halinde Esasların 8 inci maddesinin üçüncü fıkrasında belirlenen usule göre altı ayı geçmemek üzere süre uzatımı verilebilecektir.
3) Esasların uygulanmasında tereddüt duyulan hususların giderilmesi konusunda Kamu İhale Kurumu yetkili kılınmıştır. Ancak, idarelerce bu kapsamdaki başvuruların bağlı, ilgili veya ilişkili olunan bakanlık aracılığıyla yapılması gerekmektedir. Yükleniciler tarafından tereddüt duyulan hususlara ilişkin başvurular ise öncelikle sözleşmenin tarafı olan idareye yapılacaktır.
